Idaho State Rep. Butch Otter, a Republican candidate for governor and a long-time supporter of private property rights, is opposing a ballot initiative that would limit the use of eminent domain. Otter says he understands the idea behind Proposal 2, but the conflicting opinions on what the law would actually do make it a “recipe for lots of lawsuits,” according to the Idaho Statesman. Prop. 2 is one of several laws on the November ballot in several states that are intended to counteract the 2005 U.S. Supreme Court decision that cleared the way for local governments to invoke eminent domain to seize private property to make way for economic development.
